Unless your agency is in MTW or files exclusively through FRS, HUD begins enforcing HOTMA sections 102 and 104 on January 1, 2027. Every agency that is not exempt has to make its discretionary policy elections, write them into its ACOP or HCV Administrative Plan, and have its board adopt them in the open.

The date that actually bites is earlier. HUD Notice PIH 2026-15 says agencies beginning annual reexaminations 120 days ahead of their effective date need HOTMA policies in the hands of staff from September 2026 — not when the board finally votes.

Four steps, in this order, with the intervals fixed by 24 CFR 903. The 45-day notice is the one that surprises people — miss it and the hearing has to move.

1 · Publish the public notice

Not later than 45 days before the hearing, publish notice of its date, time and place AND make the proposed policy available for inspection at your principal office. Both halves are required. 24 CFR 903.17(b).

2 · Consult the Resident Advisory Board

The RAB makes recommendations and you must consider them in preparing the final version. Keep a copy of the recommendations and a written description of how you addressed them. 24 CFR 903.13(a)(1), (c).

3 · Hold the public hearing

Conducted by the board or similar governing body, at a location convenient to the residents you serve, with reasonable outreach to encourage participation. 24 CFR 903.17(a), (c).

4 · Adopt it at an open meeting

A significant amendment may not be adopted until the board has duly called a meeting and that meeting, at which it is adopted, is open to the public. 24 CFR 903.21(a)(1).
